Terms of Service

These Terms of Service ("Terms") govern your access to and use of The 99 Social™ and The 99 Pro subscription service, operated by Fairfield Kr8tive LLC ("we," "us," or "Company"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

01 — The service

The 99 Social is a hyperlocal community platform for the California Highway 99 corridor (Fresno, Bakersfield, Stockton, Modesto, and surrounding communities). The 99 Pro is a paid subscription tier providing access to the full feed, posting privileges, AI-powered digest, Pro badge, and other features described at the time of purchase.

02 — Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

03 — Your content

You own your content. Posts, photos, and other content you submit ("User Content") remain yours. You retain all ownership rights.

License to us. By posting User Content, you grant Fairfield Kr8tive LLC a non-exclusive, royalty-free, worldwide license to display, distribute, and use your content within the Service. This license ends when you delete your content or account, except where your content has been shared by others or incorporated into derivative works on the platform.

Ghost Posts. Ghost Posts are displayed anonymously but remain associated with your account in our database for moderation purposes. You are responsible for all content posted under your account, whether named or as Ghost.

Content standards. You agree not to post content that is illegal, harassing, threatening, defamatory, obscene, or that infringes any third party's intellectual property rights. We reserve the right to remove content and suspend accounts that violate these standards at our sole discretion.

04 — Intellectual property

The 99 Social™, The 99 Pro™, the platform design, the 99 Pulse, Valley Tagger, and all original features and branding are the intellectual property of Fairfield Kr8tive LLC. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary technology outside the normal use of the Service.

05 — DMCA / copyright claims

If you believe content on the Service infringes your copyright, send a DMCA notice to our designated agent at dmca@the99social.com including: identification of the copyrighted work; identification of the infringing material and its location; your contact information; a statement of good faith belief; and your electronic or physical signature. False DMCA claims may result in liability under 17 U.S.C. § 512(f).

06 — Subscriptions and payments

The 99 Pro is not currently available for purchase. Posting, commenting, and the core app are free. If and when Pro launches, it will be a recurring subscription processed by Stripe, auto-renewing unless cancelled before the renewal date, cancellable at any time from your account settings — this section will be updated with real pricing before that happens.

Refunds. We do not offer refunds for partial subscription periods. If you cancel mid-period, you retain Pro access through the end of the current billing period. Contact us at support@the99social.com for billing disputes.

Price changes. We will provide at least 30 days notice of any price increases before they take effect.

07 — Prohibited conduct

You agree not to:

Scrape, crawl, or automate access to the Service without our written permission; use the Service to spam, harass, or harm other users; attempt to circumvent any access controls, rate limits, or security measures; impersonate any person or entity; use the Service for any illegal purpose; sell, transfer, or sublicense your account.

08 — Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

09 — Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIRFIELD KR8TIVE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10 — Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Stanislaus County, California, or in federal courts for the Eastern District of California.

11 — Changes to these terms

We may update these Terms at any time. For material changes, we will notify active subscribers by email at least 14 days before the change takes effect. Continued use of the Service after that date constitutes acceptance of the new Terms.
